Q4 2026 Bail Legislation Snapshot →
California's session closed with one new consumer-protection law for bail agents and two industry bills held in committee, while several states moved to widen preventive detention through constitutional amendments.
- Preventive detention is spreading through constitutional amendments rather than higher bail amounts, in Texas, Tennessee, Indiana, Delaware and Alabama.
- California's industry bills focused on consumer protection and licensing: AB 1927 became law, while SB 562's refund mandate and SB 1026's recovery reforms stalled.
- Courts continue to require individualized, affordability-aware findings, as reflected in California's revised CR-104 form and LA's release protocol.
